TERMS OF SERVICE

By using the Services, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services.

1. Eligibility

   • You must be at least 13 years old (or the age of digital consent in your region).

   • If you are under 18, you may use the Services only with consent and supervision of a parent/guardian or your school.

   • If you use the Services on behalf of a school or other organization, you represent you have authority to accept these Terms for that organization.

2. Accounts and Security

   You are responsible for your account, your content, and safeguarding your credentials. Tell us promptly about any unauthorized use.

3. Educational Purpose and Academic Integrity

   Dysfixed supports learning and accessibility (e.g., scribe accommodations). Do not use the Services to violate school or testing rules. For any assessment, you are responsible for confirming the tool is permitted.

4. AI and Accuracy

   The Services may use AI and automated speech recognition. AI can make mistakes. You are responsible for reviewing and verifying outputs before using them. We make no guarantees about accuracy, completeness, or fitness for a particular purpose.

5. School Use and Student Data

   • Schools are responsible for obtaining required consents and ensuring use complies with applicable laws (e.g., FERPA) and local policies.

   • Where we act as a school service provider under a written agreement, we process student data as directed by the school and as described in that agreement and our Privacy Policy.

   • For direct family use, parents/guardians consent to the child’s use and data processing as described in our Privacy Policy.

6. Your Content and License

   You retain ownership of content you submit (e.g., audio, notes, prompts) (“Your Content”). You grant us a worldwide, royalty-free license to host, process, transcribe, analyze, and display Your Content solely to operate, secure, and improve the Services. If you provide feedback, you grant us the right to use it without restriction or compensation.

7. Acceptable Use

   Do not break laws, infringe rights, upload unlawful or harmful content, attempt to disrupt or reverse engineer the Services, or use the Services to build a competing product. Avoid uploading sensitive personal data that is not necessary to use the Services.

8. Intellectual Property

   The Services (including software, models, and brand elements) are owned by Dysfixed or our licensors and are protected by intellectual property laws. These Terms do not grant rights to our trademarks or code beyond what’s needed to use the Services.

9. Third-Party Services

   We may integrate third-party services (e.g., cloud, transcription). Their terms may apply; we are not responsible for their content or actions.

10. Beta Features

    Some features may be labeled “beta” or “preview.” They may change or be discontinued at any time.

11. Fees (If Applicable)

    If we offer paid plans, fees and billing terms will be shown at purchase. Fees are non-refundable unless required by law. We may change prices or features on notice as permitted by law.

12. Termination

    You may stop using the Services at any time. We may suspend or terminate access if you violate these Terms or if we discontinue the Services. Sections that should survive (e.g., IP, disclaimers, limitations) will survive termination.

13. Disclaimers

    THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

14. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY LAW, DYSFIXED AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATING TO THE SERVICES IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM (OR $100 IF YOU PAID NOTHING).

15. Indemnification

    You agree to indemnify and hold Dysfixed harmless from claims, losses, and expenses (including reasonable attorneys’ fees) arising from Your Content, your use of the Services, or your violation of these Terms or applicable laws.

16. Copyright/DMCA

    If you believe content infringes your copyright, email a notice to [copyright@dysfixed.com] with the information required by the DMCA. We may remove content and/or terminate repeat infringers.

17. Changes to These Terms

    We may update these Terms from time to time. We will post the updated Terms with a new Effective Date. Your continued use after changes means you accept the revised Terms.

18. Governing Law and Venue

    These Terms are governed by the laws of the State of California, without regard to conflicts of law. Courts in Santa Clara County, California will have exclusive jurisdiction.
